Land listings leave out the items that decide whether a parcel is buildable. Start with water. In Montana, a water right attached to land passes with the land unless the deed expressly excepts it, so read the deed, and do not treat a Statement of Claim as proof the water was ever used. Since January 1, 2026, a new exempt well (35 gallons a minute or less, up to 10 acre-feet a year) requires a Notice of Intent to the state Department of Natural Resources and Conservation, followed by a Notice of Completion.

Then the septic. In Missoula County, a septic permit has to be finalized before other permits are issued, and groundwater monitoring where required has to start by April 1, with four feet between the drainfield and groundwater. Ravalli County requires a test hole 8 to 12 feet deep, and a nondegradation analysis for a new dwelling.

Access is the third item. Missoula County issues address and approach permits, so ask what access permits the parcel already has.
